Terms of Service
These terms are the agreement between you and Semicolon Marketing Ltd ("Dial98", "we", "us") for the Dial98 calling service and the Dial98 app. They are written to be read. If something here is unclear, email info@semicolon.live and ask before you buy credit.
1. What Dial98 is
Dial98 is a prepaid, app-based long-distance calling service. It places outbound calls from your phone, over the internet, to landline and mobile numbers in Iran (+98). It is not a replacement for your mobile carrier, and it is not an emergency service.
No emergency calling
Dial98 cannot be used to call 911, 112, 115, 125 or any other emergency number, anywhere. If you need emergency help, use your mobile network or a landline. Do not rely on this app in an emergency.
2. Eligibility and your account
- You must be at least 18 years old and legally able to enter a contract.
- One account per person. You are responsible for everything done through your account, and for keeping your password to yourself.
- The email address on the account must be one you actually control — it is how we reach you about billing and how account recovery works.
- Tell us promptly at info@semicolon.live if you think someone else has used your account.
3. Prepaid credit
- Dial98 is prepaid. You buy credit, calls draw it down, and when the balance reaches zero, calls stop. There is no invoice, no contract term and no monthly commitment.
- Credit is a right to use the service. It is not a deposit, it does not earn interest, it is not redeemable for cash, and it cannot be transferred to another account.
- Credit does not expire while your account is open and in good standing.
- Prices are quoted and charged in Canadian dollars. Your bank may add its own conversion fee; that fee is between you and your bank.
4. Per-second billing
- Answered calls are billed by the second, from the moment the call is answered to the moment it ends. There is no minimum duration and no rounding up to the next minute.
- There is no connection fee and no per-call surcharge.
- Calls that are not answered — ring-out, busy, or a failed route — are not charged.
- The per-minute rate depends on the destination (Tehran landline, Iranian mobile, other Iranian numbers). The rate that applies is the one shown in the app at the time you place the call. You can see the current price list in the app before you dial.
- Rates can change. Wholesale telecom pricing to Iran moves, sometimes sharply. We will publish any change in the app and, for an increase, email account holders before it takes effect. A change never applies retroactively to calls already made.
- Fractions of a cent are tracked internally and rounded only when a charge is written to your balance, always to the nearest cent.
- If you believe a call was billed incorrectly, tell us within 60 days and we will investigate and correct it.
5. No guarantee of connectivity to Iran
Read this before you buy credit. Dial98 hands your call to a wholesale carrier, which hands it to the Iranian telephone network. We control our part. We do not control theirs.
- The service is provided as is, with no guaranteed uptime, call-completion rate or audio quality.
- Calls to Iran can fail, drop, or degrade for reasons entirely outside our control: network congestion, filtering or throttling by Iranian authorities, carrier outages, undersea cable faults, power cuts, or the internet connection on your own phone.
- Specific numbers, area codes or entire ranges may be unreachable at times, without notice.
- Caller ID display is best-effort. Intermediate networks may alter, withhold or replace the number you have chosen to present. We cannot guarantee what appears on the other person's handset.
- Dial98 needs a working internet connection on your device. Data used by the app is billed by your own mobile carrier, not by us.
- Where a call fails, your remedy is that you are not charged for it. We are not liable for anything that follows from a call not connecting.
6. Acceptable use
Dial98 is sold for ordinary personal calling — you, calling people you know. The following are prohibited and will end your account:
- Autodialing, predictive dialing, robocalling, bulk or automated calling of any kind.
- Telemarketing, cold calling, survey or polling campaigns, or any unsolicited commercial calling.
- Fraud, impersonation, harassment, threats, or calls intended to deceive the recipient.
- Caller ID spoofing — presenting a number you do not own or are not authorised to use. You may set as your caller ID only a number that belongs to you. Misrepresenting a caller's identity is an offence in Canada under the Telecommunications Act.
- Reselling Dial98 minutes, sharing an account between people, or operating a call shop, call centre or gateway on it.
- Traffic pumping, refiling, or any scheme to generate artificial call volume.
- Any use that is illegal where you are, where the call terminates, or in Canada — including any use that would breach Canadian sanctions law.
- Attempting to break, overload, reverse-engineer or gain unauthorised access to our systems.
Recording: if you record calls, you must comply with the recording laws that apply to you and to the person you call, including telling them and getting consent where the law requires it. See the Privacy Policy, section 4.
7. Fair use
Personal accounts are for personal call volumes. If an account's usage pattern looks automated or commercial — sustained back-to-back dialing, very high call counts to unrelated numbers, or the signature of a call centre — we may ask you about it, throttle the account, or suspend it. We would rather ask first.
8. Refunds
- Billing errors are always refunded. If we charged you for a call that did not connect, or applied the wrong rate, tell us within 60 days and we will credit the difference.
- Unused credit: within 30 days of a top-up, you may request a refund of the unused portion of that top-up, back to the original payment method. We may deduct the payment processor's non-refundable fee.
- After 30 days, credit is non-refundable but remains usable for as long as the account is open.
- Credit is not refunded when an account is closed by us for a breach of section 6.
- Poor call quality or failed calls to Iran caused by conditions described in section 5 are not grounds for a refund of unused credit, beyond not being charged for the affected calls.
- Refund requests go to info@semicolon.live from the account's email address.
9. Suspension and termination
- We may suspend or close an account immediately for a breach of section 6, for suspected fraud or chargeback abuse, or where we are legally required to.
- Where the situation allows it, we will tell you why and give you a chance to explain.
- You may close your account at any time, in the app under Settings → Delete my account, or at dial98.com/delete-account. Closing an account forfeits any remaining credit, except where section 8 gives you a refund right.
- We may discontinue the service entirely with 30 days' notice, in which case unused credit is refunded.
10. Liability
To the fullest extent the law allows:
- Dial98 is provided without warranties of any kind, express or implied, including merchantability and fitness for a particular purpose.
- We are not liable for indirect, incidental, special or consequential damages, or for lost profits, lost business or lost opportunity, arising from the service or from a call that failed to connect.
- Our total liability to you, for any and all claims, is limited to the amount you paid Dial98 in the three months before the claim arose.
- Nothing here limits liability that cannot lawfully be limited, including for fraud or for death or personal injury caused by negligence. Some jurisdictions do not allow the exclusions above, in which case they apply to you only to the extent permitted.
11. Privacy
Our handling of your data is described in the Privacy Policy, which forms part of these terms.
12. Changes to these terms
We may update these terms. Material changes will be emailed to the address on your account and posted here with a new date, at least 14 days before they take effect. Continuing to use Dial98 after that date means you accept the new terms; if you do not, close your account and request a refund of unused credit under section 8.
13. Governing law
These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there, without regard to conflict-of-law rules. The courts of British Columbia have exclusive jurisdiction, and you and we both submit to them. Nothing in this section removes any right you have to bring a claim in your own country of residence where local consumer law gives you that right.
